My Handy Guy Terms and Conditions

These Terms and Conditions govern your use of the website myhandyguy.ca (the "Site"), owned and operated by Muhammed Enes Camur. By accessing or using the Site, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you must not use the Site.

Intellectual Property

All content published and made available on the Site, including but not limited to text, graphics, logos, images, audio, video, software, and other materials (collectively, the "Content"), is the property of Muhammed Enes Camur and is protected by applicable Canadian and international intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content on the Site without the prior written consent of the Site owner, except as permitted by these Terms.

Acceptable Use

As a user of the Site, you agree not to:

We reserve the right to limit, suspend, or terminate your access to the Site at our sole discretion, without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise inappropriate.

Sale of Services

My Handy Guy offers the following services through the Site:

All services are to be paid in full upon completion of the work unless otherwise agreed upon in writing. Pricing for services is as listed on the Site at the time of booking, and we reserve the right to adjust pricing at any time without prior notice.

We reserve the right to modify, reject, or cancel any service order at our sole discretion. If we cancel an order after payment has been received, a full refund will be issued.

Subscriptions

Certain services or features offered through the Site may be provided on a subscription basis. Subscriptions will automatically renew at the end of each billing period unless you cancel your subscription before the renewal date. You may cancel your subscription at any time by contacting us or through your account settings on the Site. Cancellation will take effect at the end of the current billing period.

Payments

We accept the following payment methods on the Site:

By providing your payment information, you authorize us to charge the applicable fees to your chosen payment method. You represent and warrant that you have the legal right to use the payment method you provide and that the information you supply is accurate and complete. We are not responsible for any fees or charges imposed by your payment provider in connection with our processing of your payment.

Refunds

Refund requests will be reviewed on a case-by-case basis. If you are not satisfied with a service provided by My Handy Guy, please contact us within 14 days of service completion to discuss your concerns. We may, at our sole discretion, offer a full or partial refund, a service credit, or arrange for the service to be re-performed. Refunds, if approved, will be issued to the original payment method within a reasonable timeframe.

Consumer Protection Law

Where the Ontario Consumer Protection Act, 2002 or any other applicable consumer protection legislation in the Province of Ontario applies to your use of the Site or the services provided, such legislation will prevail to the extent of any inconsistency with these Terms. Nothing in these Terms is intended to limit or exclude any rights you may have under applicable consumer protection laws.

Links to Other Websites

The Site may contain links to third-party websites or services that are not owned or controlled by My Handy Guy. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that My Handy Guy shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services.

Limitation of Liability

To the fullest extent permitted by applicable law, Muhammed Enes Camur and My Handy Guy, including its officers, directors, employees, agents, and affiliates, shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Site or services; (b) any unauthorized access to or alteration of your transmissions or data; (c) any statements or conduct of any third party on the Site; or (d) any other matter relating to the Site or services. In no event shall our total liability to you for all claims exceed the amount paid by you, if any, for accessing or using the Site or services during the twelve (12) months preceding the claim.

Indemnity

You agree to defend, indemnify, and hold harmless Muhammed Enes Camur, My Handy Guy, and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to reasonable legal fees) arising from or related to (a) your use of and access to the Site or services; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, property, or privacy right; or (d) any claim that your use of the Site or services caused damage to a third party.

Applicable Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the Province of Ontario.

Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site or services, the parties agree to first attempt to resolve the matter through good-faith mediation. If mediation is unsuccessful, the dispute shall be submitted to binding arbitration in accordance with the rules of the ADR Institute of Ontario. The costs of mediation and arbitration shall be shared equally between the parties.

Notwithstanding the foregoing, either party retains the right to bring an action in the Small Claims Court of Ontario for any claims within its jurisdiction.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced by a valid, enforceable provision that most closely reflects the intent of the original provision.

Changes

We reserve the right to amend these Terms and Conditions at any time at our sole discretion. If we make material changes to these Terms, we will notify you by email or by posting a prominent notice on the Site prior to the changes taking effect. Your continued use of the Site after the effective date of the revised Terms constitutes your acceptance of the updated Terms.
